TERMS AND CONDITIONS

  1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these terms and conditions.
  2. The promotion is open to Australian residents aged 18 years and over.
  3. Employees (and their immediate families) of Frucor Suntory Australia (‘the Promoter’) and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
  4. Entries into the promotion open at 12:01am AEDST on 25/10/2022 and close at 11.59pm AEDST on 10/01/2023 (“Promotional Period”).
  5. To be eligible to enter, individuals must purchase any two (2) V Energy drink products (“Qualifying Product”) from any retailer during the Promotional Period and collect a receipt at the time of purchase of the Qualifying Product (“Qualifying Transaction”). In the event that a receipt is not automatically provided to an individual upon completion of their Qualifying Transaction, it is the individual’s responsibility to request one from the retailer.
  6. For the avoidance of doubt, V 250mL multipacks count as one (1) Participating Product.
  7. To enter the promotion, individuals must visit v-energy.com.au/win or scan the QR Code on the promotional poster, input the requested details (including but not limited to full name, phone number and email address), upload a copy of their Qualifying Transaction receipt and then submit the fully completed entry form during the Promotional Period.
  8. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used by that entrant.
  9. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per Qualifying Product; (b) each entry must be submitted separately and in accordance with entry requirements at clause 6; and (c) a maximum of one (1) entries per person per day is Any additional entries submitted by an entrant will be deemed invalid.
  10. Entrants must retain their original OR a copy of their purchase receipt for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. In that case, the entrant will not be entitled to compensation.
  11. The Major Prize Draw & Runner Up Prize Draw will take place at Bamboo Marketing, 1.24, 90-96 Bourke Road, Alexandria 2015 NSW on 16/01/2023 at 11am AEDST, in the presence of an independent scrutineer. The Promoter may draw additional entries and record them in order in the event that an invalid entry or ineligible entrant is drawn. The Promoter will draw the Major Prize and Runner-up Prize winners from all valid entries received by the Promoter during the Promotional Period. The Major Prize and Runner-up Prize winners will be the registered owner of the phone number provided at the time of entry.
  12. The first two (2) valid entries from the prize draw will win an Australian Camper Trip with a RRP of $7,857. The Australian Camper Trip includes the below:
    • Return economy airfares for two (2) from the winners nearest Australia capital city, to Adelaide, SA;
    • All airline and airport taxes;
    • Return private transfers from Adelaide airport to VW Kombi pick up location;
    • 7 days and 6 nights VW Kombi hire with standard excess included (minimum age for driver must be 21 years of age); and,
    • $1000 AUD spending money

  13. The Major Prize winners will be contacted by phone and email using the details provided at the time of entering the promotion.
  14. If the Major Prize winner is under 21 years, they must ensure one of their chosen travel companion (who will drive the rental car) is 21 years or older and holds a full Australian drivers’ licence in order to claim the Major Prize. If a Major Prize participant is under the age of 18 they must be accompanied by a parent or guardian.
  15. The Major Prize is valid for 12 months from when Major Prize winner’s name is drawn. Block out periods include all Australian School & Public Holidays along with all other special event periods.
  16. All bookings must be made a minimum of 60 days in advance of requested departure dates. All bookings and documentation regarding the prize must be made via the Promoter’s chosen travel partner and their agents.
  17. Redeeming the prize is conditional on acceptance of the terms and conditions of travel as detailed by the Promoter’s chosen travel partner and the airline carriers in accordance with normal travel practices.
  18. Winner is responsible for any amendments, fees issued by airlines or suppliers once booking is confirmed and ticketed. Winner is responsible for any additional taxes and/or resort fees associated with the chosen accommodation, unless otherwise stated. Any additional spending money, meals (other than those included) and any other ancillary costs, including but not limited to insurance and any applicable insurance excesses, not listed in the travel prize package descriptions above are the responsibility of the travel prize winner and his/her nominated traveling companions as incurred. All costs & fees associated to stay at campsites is the responsibility of the winner and not included in the Major Prize.
  19. It is the winner’s responsibility to organise transport to and from the airport when both departing and returning to the major city.
  20. Prize winner and their travel companion must have valid travel insurance for their period of travel.
  21. The following 50 valid entries from the prize draw will win a $100 fuel voucher.
  22. Fuel vouchers will be fulfilled via a digital Prezzee smart card that will be emailed to the email address provided at point of entry.
  23. The Prezzee Smart eGift card can only be exchanged for individual retailer gift cards online. These individual retailer gift cards can be redeemed in-store or online, dependent on retailer terms and conditions. Please review all applicable retailers’ terms and conditions prior to the purchase of any Gift Card.
  24. Any ancillary costs associated with redeeming a Prezzee Smart E Gift Card are not included. Any unused balance of a Prezzee Smart E Gift Card will not be awarded as cash. Redemption of a Prezzee Smart E Gift Card is subject to any terms and conditions of the issuer including those specified on the Prezzee Smart E Gift Card.   (“Runner Up Prizes”)
  25. The total prize pool value is up to AUD$20,714
  26. All prize winners will be contacted by email using the details provided at the time of entry within five (5) business days of Major & Runner up Prize draws.
  27. The prize RRPs are correct at the time of printing these Terms and Conditions and all in-store point of sale materials, and the Promoter takes no responsibility for any changes to the RRP stated.
  28. Prizes, or any unused portion of a prize, are not transferable, changeable or redeemable for cash.
  29. In the event that a prize or any part of a prize becomes unavailable for any reason beyond the Promoter’s control, the Promoter reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
  30. Subject to the unclaimed prize draw clause, if for any reason a winner does not take/redeem a prize (or an element of the prize) at/by the time stipulated by the Promoter, for any reason, then the prize (or that element of the prize) will be forfeited, and no compensation will be payable.
  31. In the event an invalid or ineligible entry is drawn, or the Promoter is unable to contact a winner within fourteen (14) days of first attempting to notify that winner, having made reasonable attempts to do so, the Promoter may deem that winner’s entry invalid, and no compensation will be payable.

  33. A draw for any unclaimed Prizes may take place on 17/04/2023 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified by phone and email within two (2) business days of the unclaimed prize draw and their names will be published on v-energy.com.au/win from 24/04/2023.
  34. Acceptance of any prize is deemed consent for the Promoter to use the winner’s name, likeness, image and/or voice for promotional and media purposes without compensation, and any copyright will vest in the Promoter.
  35. The Promoter’s decision is final on all matters and no correspondence will be entered
  36. The Promoter reserves the right to amend, suspend or cancel any aspect of this promotion (including any prize or term) at any time in its sole discretion, subject to any written directions from a relevant regulatory authority.
  37. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  38. The Promoter reserves the right to disallow entries in its absolute discretion and without giving reasons.
  39. The Promoter reserves the right to verify the validity of the winner’s entry and disqualify any entry or refuse to award a prize where false or misleading details have been given by an entrant or an entrant has behaved in a fraudulent, dishonest or disruptive manner, or otherwise than in accordance with these terms and conditions or the spirit of the promotion.
  40. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the

If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  42. Quality control errors will not invalidate an otherwise valid prize claim.
  43. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant
  44. To the extent permitted by law, the Promoter and its agents take no responsibility for any failure of any entry to be entered into the promotion due to, without limitation, technical malfunction or human error. The Promoter and its agents are not responsible for late, lost or misdirected entries. Incomplete or indecipherable entries will be deemed invalid.
  45. Entries are deemed received at the time they are received by the Promoter, and not at the time of transmission by the entrant.
  46. As a condition of participating in the promotion, each winner indemnifies the Promoter, all organisers, sponsors and all other persons and organisations associated in any way with this promotion against all claims, damages, liabilities, costs and expenses (including costs on a solicitor-client basis) which a winner may incur arising out of their participation in the promotion and/or use of a prize, howsoever caused.
  47. Except for any liability that cannot be excluded by law, the Promoter excludes all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where attributable to any of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected; (d) any variation in the prize; (e) any tax liability incurred by a claimant or entrant; or (f) use of a prize.
  48. As a condition of accepting the Major Prize, the winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
  49. The Promoter collects and holds personal information provided by entrants for the purposes of this Promotion and for future promotional purposes. For the purposes of this promotion, which includes notifying the winners and facilitating redemption of prizes, the Promoter may pass winners’ personal details to their agencies and other associated organisations. Failure to provide requested personal information may disqualify a person from being able to receive a prize. All personal information provided by entrants will be held by the Promoter and used and handled in accordance with its Privacy Policy, which can be viewed at https://www.frucorsuntory.com/privacy-policy/. Under the Privacy Act 1988, entrants have the right to access and correct any such personal information.
